Welcome to Kuchanga! These Terms of Service ("Terms") govern your use of the Kuchanga website, mobile applications, and services (collectively, the "Platform") provided by Kuchanga ("we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, purchasing tickets, listing events, or otherwise using the Platform, you affirm that you are of legal age to enter into this agreement in Malawi and agree to these Terms. If you do not agree, you must not use the Platform.
2. User Accounts
You may need to register for an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Users in Malawi must provide accurate and current information during registration.
3. Event Listings and Content
Event Organisers are responsible for the accuracy, legality, and content of their event listings. Kuchanga reserves the right to remove any content that violates these Terms or applicable Malawian laws. You grant Kuchanga a license to use content you post for the purpose of operating and promoting the Platform.
4. Ticket Purchases and Payments
All ticket purchases are subject to availability and the terms set by the Event Organiser. Payments are processed through third-party payment gateways (e.g., PayChangu, mobile money operators like Airtel Money, TNM Mpamba). All prices are listed in Malawian Kwacha (MWK) unless otherwise specified. Kuchanga is not responsible for issues arising from payment gateway services but will endeavor to assist where possible.
5. Cancellations, Refunds, and Postponements
Refund policies are determined by the Event Organiser. Kuchanga's default position is that tickets are non-refundable except in cases of event cancellation by the organiser. If an event is cancelled, Kuchanga will work with the organiser to facilitate refunds according to the organiser's policy and applicable Malawian consumer protection laws.
6. Prohibited Conduct
You agree not to use the Platform for any unlawful purpose or in any way that could harm the Platform, its users, or third parties. This includes, but is not limited to, posting fraudulent events, scalping tickets in violation of event terms, infringing intellectual property, or distributing malware.
7. Intellectual Property
The Platform and its original content, features, and functionality are owned by Kuchanga and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
8. Disclaimers and Limitation of Liability
The Platform is provided "as is" and "as available." Kuchanga disclaims all warranties, express or implied. We do not guarantee that the Platform will be error-free or uninterrupted. To the fullest extent permitted by Malawian law, Kuchanga shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Malawi, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
